Terms of Use for Artificial Intelligence Features

These AI Terms govern your use of artificial intelligence-powered features and functionality (collectively, "AI Features") provided by GoMarble AI ("GoMarble," "we," or "us") as part of our Services. These AI Terms supplement our primary Terms of Use and Privacy Policy.
1. Use of AI Features
GoMarble AI provides AI-powered tools for advertising performance analysis, campaign optimization, media analysis, content strategy, conversational Q&A, session history and personalization, and automated campaign management (the "AI Agent"). The AI Agent may, upon your authorization, take real actions on connected advertising platforms on your behalf, including creating, updating, pausing, or cloning campaigns, ad sets, and ads.
These tools rely on third-party foundational models, including but not limited to:
Anthropic Claude
Google Gemini
OpenAI
We provide access to AI Features for informational and productivity-enhancing purposes only. Outputs are generated based on user inputs and should not be relied upon as definitive, legally binding, or fully accurate statements.
2. Third-Party Model Providers
The AI Features are powered by foundational models developed by third-party providers. By using these features, you also agree to be bound by the relevant terms of these providers:

GoMarble does not assume responsibility for the functionality, availability, or limitations of these underlying model providers.
3. Data Usage & Privacy
We process your inputs and model outputs to:
Deliver and improve AI functionality
Diagnose errors and performance
Maintain safety and integrity of the platform
Extract and store session summaries to personalize your experience (see Section 3a below)
We do not use your data to train any third-party foundation models. For more details, refer to our Privacy Policy.
Some processing may involve transfer of data to subprocessors or AI model providers located outside your jurisdiction. Please refer to our Data Processing Agreement (DPA) for further details.
3a. Personalization Data
The AI Agent extracts and persistently stores summaries derived from your conversations, including:
Session summaries: past problems you described, actions taken, and outcomes observed
User preferences: your preferred report format, communication style, review cadence, and workflow patterns
These records are stored in GoMarble's database, scoped to your user account and team, and are used to make the AI Agent more relevant and efficient over time. You may request deletion of all stored records at any time by contacting legal@gomarble.ai.
3b. LLM Observability
GoMarble uses Langfuse, an LLM observability platform, to log all AI interactions for quality monitoring, debugging, and cost management. Langfuse receives prompts, completions, token usage, and latency metadata. Langfuse processes this data under contractual data processing agreements with equivalent security obligations.
4. Agentic Actions
4.1 Scope of Agent Actions
The AI Agent can take the following categories of real actions on connected Meta (Facebook/Instagram) and Google Ads accounts on your behalf:
Meta Ads:
Create, update, pause, activate, or clone campaigns (including budget and bid strategy changes)
Create, update, or modify ad sets (targeting, daily/lifetime budgets, schedule, optimization goal)
Create, update, or clone ads and ad creatives (copy, headlines, images, video, destination URLs)
Google Ads:
Update campaigns (budget, bidding strategy, status)
Update ad groups (name, bid, status)
Update ads (headlines, descriptions, display URLs, final URLs)
Update Performance Max asset groups
All supported actions are subject to change as GoMarble AI expands platform integrations. The current action scope is limited to Meta Ads and Google Ads. No agentic actions are executed on TikTok, LinkedIn, or other platforms at this time.
4.2 Propose-Approve Workflow
Every AI Agent action goes through a mandatory two-stage workflow:
Propose: The AI Agent generates a preview of the proposed change, including a summary, the list of fields to be modified, any warnings (e.g., "this will activate the campaign immediately"), and an estimated impact. This proposal is presented to you for review.
Approve: You must explicitly approve the proposal before any action is executed. You may also edit individual fields within a proposed action before approving. Edited fields are revalidated against business rules before execution proceeds.
You must not bypass, automate, or programmatically approve the review step. The purpose of this review is to give you a meaningful opportunity to catch errors before they take effect.
4.3 Approval Timeouts
If you do not approve or reject a proposed action within the approval window (minimum 2.5 minutes; scaled up for batches of multiple operations), the operation is automatically cancelled and marked as timed out. A timed-out operation has no effect on your ad accounts. If you re-propose the same action, a new approval cycle begins. Be aware that re-proposing after a timeout may result in duplicate campaign objects or duplicate spend if you are not certain the original operation did not execute.
4.4 Execution and Partial Failure
Once approved, actions execute against the ad platform API. In a batch of multiple approved actions:
Each action is tracked individually; one failure does not block others
If an action fails at the platform API level, it is marked as failed in GoMarble AI's system and not retried automatically
There is no automatic rollback. Actions that completed before a mid-batch failure remain in effect on the ad platform. GoMarble AI cannot undo changes already applied to your ad accounts.
In rare cases of network or API errors, an action may execute on the ad platform while GoMarble AI's system records it as failed. You should verify the state of your ad accounts directly in the ad platform after any execution errors.
4.5 Financial Risk
By authorizing AI Agent actions, you acknowledge and accept the following:
Ad spend: Any action that activates a campaign or ad set (status set to ACTIVE) will cause advertising spend to begin immediately. GoMarble AI is not responsible for any advertising spend resulting from actions you have approved.
Budget values: Campaign and ad set budgets are expressed in your ad account's native currency. You are responsible for verifying that budget values in proposed actions match your intent before approving.
No spend guarantee: GoMarble AI does not guarantee any advertising outcome, return on ad spend, or performance result from AI Agent actions.
Platform charges: All advertising spend is billed directly by the ad platform (Meta, Google, etc.) to your payment method on file with that platform. GoMarble AI has no visibility into or control over these charges after an action executes.

4.6 Platform Policy Compliance
GoMarble AI does not pre-screen AI-generated ad content for compliance with Meta Advertising Standards, Google Ads policies, or any other ad platform's content policies. You are solely responsible for ensuring that all proposed actions — including creative content, targeting parameters, and campaign settings — comply with applicable platform policies. Consequences of policy violations (including ad rejection, account restriction, or account suspension) are your sole responsibility.
5. Acceptable Use
You must not use AI Features to:
Generate unlawful, harmful, misleading, or discriminatory content
Violate the intellectual property rights of others
Automate decisions with legal or significant personal impacts without human oversight
Take actions on ad platforms that violate those platforms' terms of service
Circumvent safety measures or content policies of any AI model provider
We reserve the right to suspend or terminate access to AI Features for violations of these terms.
6. Limitations & Disclaimer
AI-generated content may:
Contain factual inaccuracies
Reflect biases from training data
Be inappropriate in certain contexts
Result in suboptimal advertising decisions if relied upon without human review
GoMarble does not guarantee the accuracy, completeness, or suitability of AI outputs. You are solely responsible for verifying results and using them in a manner compliant with applicable laws and platform policies.
7. Feedback & Improvements
We may use aggregated and de-identified usage patterns to improve our AI Features. Where data is used for improvement purposes, it is anonymized or aggregated such that it cannot be linked back to individual users. Individual prompt and completion data logged to Langfuse is used solely for operational monitoring, not for model training.
You grant us the right to use such non-personal data for research, analysis, and feature development.
8. Changes to These Terms
We may update these AI Terms from time to time. Continued use of AI Features after any updates constitutes acceptance of the revised terms.
